Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the AI Video Generator mobile application and related services (collectively, the “Service”) provided by SMART CREATOR AI LLC, a limited liability company organized under the laws of the State of Wyoming, United States (“we”, “us”, or “our”). By downloading, installing, or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. The Service
AI Video Generator allows you to create short videos using generative AI models, optionally starting from a photo you upload. Output quality, processing time, and feature availability depend on third-party model providers and may change at any time without notice.
3. Account & Device Identity
The Service does not require traditional accounts. We associate your videos and subscription state with a device-generated identifier and a public cryptographic key. You are responsible for safeguarding the device used to access the Service.
4. Subscriptions, Credits & Billing
- The Service is offered on a subscription basis. Subscriptions are billed through your app store account (Apple) and are subject to that store’s payment terms.
- Each weekly billing period grants a fixed credit allowance, which is consumed by generations. Unused credits do not roll over.
- Subscriptions renew automatically at the then-current price until cancelled. You can cancel anytime in your app store’s subscription settings; cancellation takes effect at the end of the current billing period.
- All purchases are subject to the refund and cancellation rules in Section 5 below.
5. Refunds & Cancellation
Due to the nature of digital services, subscriptions are generally non-refundable, except where required by applicable law. Prior billing periods are non-refundable unless required by applicable law. To avoid future charges, subscriptions must be cancelled before the end of the current subscription period through the applicable app store. Once cancelled, you will continue to have access to the Service until the end of your current subscription period, after which your subscription will not renew.
How to cancel (iOS / App Store): open Settings → tap your Apple ID → Subscriptions → select AI Video Generator → Cancel Subscription. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until that date.
Requesting a refund from the App Store: because purchases are processed by the App Store, refund requests are handled by Apple. You can request a refund directly at reportaproblem.apple.com. We do not control or guarantee the outcome of an App Store refund decision.
If you believe there are exceptional circumstances regarding your purchase, please contact us at the address in Section 15 and we will review your request.
6. Your Content
You retain ownership of the photos and prompts you submit (“Inputs”) and of the videos generated from them (“Outputs”), to the extent such ownership is available under applicable law. By using the Service, you grant us a worldwide, royalty-free, non-exclusive licence to process your Inputs and Outputs for the purpose of operating, securing, and improving the Service.
You represent and warrant that you own or have the necessary rights to your Inputs, and that your Inputs and Outputs do not infringe any third party’s rights or violate any law.
7. Acceptable Use
You agree not to use the Service to generate content that:
- depicts a real person without their informed consent;
- depicts a minor in a sexual, violent, or otherwise harmful context;
- is intended to harass, defame, deceive, or impersonate any person;
- depicts non-consensual sexual content of any kind;
- promotes violence, terrorism, self-harm, or illegal activity;
- infringes any intellectual property, privacy, or publicity right; or
- circumvents content filters, rate limits, or other technical safeguards.
We may suspend or terminate access for users who violate these rules and may remove offending content without prior notice.
8. Third-Party Services
The Service relies on third-party providers including app stores, payment processors, and AI model vendors. Your use of those services is also subject to their respective terms and privacy policies.
9. Intellectual Property
The Service, including its software, design, trademarks, and underlying technology, is owned by SMART CREATOR AI LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes, subject to these Terms.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUTS WILL MEET YOUR EXPECTATIONS. GENERATIVE AI OUTPUTS MAY CONTAIN INACCURACIES OR ARTEFACTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMART CREATOR AI LLC AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, OR DATA, ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service for any reason, including violation of these Terms. Upon termination, the licences granted to you will end and provisions that by their nature should survive will survive.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date at the top of this page. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of such courts.
